1. Acceptance of Terms

By accessing and using EmailsWave products and services, including the email marketing platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services

EmailsWave provides email infrastructure software and an email marketing campaign management platform. Our services include campaign creation and management, contact list management, email template storage, SMTP configuration, delivery tracking, and multi-cloud server provisioning. These services are designed for legitimate bulk email sending in compliance with applicable laws.

3. Account Registration

To access the email marketing platform, you must register for an account with a valid email address. All new accounts require administrator approval before access is granted. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Acceptable Use

You agree to use our products and platform in compliance with all applicable laws, including anti-spam regulations such as CAN-SPAM, GDPR, and CASL. Specifically, you will: (a) only send emails to recipients who have opted in to receive communications, (b) include a valid unsubscribe mechanism in all marketing emails, (c) not send content that is illegal, harmful, or deceptive, and (d) not use the platform for phishing, malware distribution, or fraudulent activities.

5. Licensing

Our software is licensed, not sold. License terms, pricing, and usage limits are defined in your individual license agreement. The platform service is provided on a per-account basis with features determined by your subscription or approval level.

6. Data Ownership

You retain ownership of all data you upload to the platform, including contact lists, email templates, and campaign content. EmailsWave does not claim ownership of your data and will not access it except as necessary to provide the service.

7. Limitation of Liability

EmailsWave shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or platform, including but not limited to lost revenue, email deliverability issues, or third-party service outages. Our total liability shall not exceed the amount paid for the specific product or service in the preceding 12 months.

8. Termination

We reserve the right to suspend or terminate access to our services if you violate these terms, engage in activities that harm our platform or other users, or use the platform for sending unsolicited or illegal email campaigns. Upon termination, your data will be retained for 30 days before permanent deletion.

9. Changes

We may modify these terms at any time. We will notify registered users of material changes via email. Continued use of our services after modifications constitutes acceptance of the updated terms.
